Protecting one’s own data is a challenge for every company and requires the utmost attention at all times. The Trade Secrets Act passed by the Bundestag has put the issue, which is unfortunately still far too often suppressed by companies, back on the agenda. Up to now, the matter was quite simple: internal company information could be declared a trade secret without any major effort and sensitive information was secure – but this regulation puts an end to this. Protect company data effectively<\/h2>\n

To ensure that data continues to be subject to comprehensive protection, the Trade Secrets Protection Act requires “appropriate confidentiality measures” to be observed. This means that you should always be able to explain what specific measures you have taken and that these are appropriate to the situation. As always, prevention is better than cure, because in plain language this means that if you are not vigilant enough when it comes to the security of your company’s internal know-how, you will no longer be able to enforce injunctions, contractual penalties or damages. However, there is no obligation to implement the GDPR, for example. <\/p>\n
