“Processors” are natural or legal persons, authorities, institutions or other bodies that process personal data on behalf of the controller.
g) Receiving party
“Recipients” are natural or legal persons, authorities, institutions or other bodies to whom personal data is disclosed, regardless of whether they are third parties or not.
h) Third parties
“Third party” means a natural or legal person, public authority, agency or body other than the data subject, controller, processor and persons who, under the direct authority of the controller or processor, are authorized to process personal data.

4. processing of personal data on the Materna Virtual Solution website – purposes and legal bases, recipients
a) Collection of personal data and information when accessing the Materna Virtual Solution website
Each time the Materna Virtual Solution website is accessed by users, information without personal reference and personal data of these users is collected and stored in the log files of the Materna Virtual Solution server. The (1) browser types, versions and language settings used, (2) the operating system used by the users, (3) the website from which the users access our website (so-called referrer), (4) the sub-websites which are accessed by the users on our website, (5) the date and time of access to our website, (6) the Internet Protocol address (IP address) of the users, (7) the Internet service provider of the users and (8) the amount of data accessed are collected and stored.

Which personal data is transmitted to Materna Virtual Solution in the process is determined by the respective input mask or contact form for registration or contacting. The personal data transmitted by the data subject to Materna Virtual Solution is collected and stored exclusively for the purposes of the registration or for processing the contact request of the data subject. d) Direct advertising, product information and newsletters from Materna Virtual Solution
On the website, we offer the option of receiving direct advertising, product information and newsletters from Materna Virtual Solution by e-mail. For this purpose, we require the data subject’s e-mail address.

The Materna Virtual Solution website uses cookies. Cookies are small text files that are stored on the user’s end device via an Internet browser when they visit our website and are stored there for later retrieval. We use Polylang, a plugin from WP SYNTEX, 8, rue Joseph Cugnot 38307 Bourgoin Jallieu, France, for the multilingual presentation of our website. Polylang makes it possible to provide content in different languages and to improve the user experience by adapting the language of the website.
When using Polylang, technically necessary cookies are set to save the language you have selected and to display it automatically on your next visit. h) Use of Google Ads
Materna Virtual Solution has integrated Google Ads on its website. Google Ads is an Internet advertising service that enables advertisers to place ads in Google search engine results as well as in the Google advertising network and is offered by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (hereinafter “Google”).
The purpose of Google Ads is to promote our website by displaying targeted advertising on the websites of third-party companies and in the search engine results of the Google search engine and to display targeted third-party advertising on our website.
If users reach our website via a Google ad, a conversion cookie is stored in the user’s browser by Google (for cookies, see section 4 d above). The conversion cookie can be used to track whether certain subpages on our website have been accessed. The conversion cookie is deleted after thirty days.
Google uses conversion cookies to create visit statistics for our website, which we use to determine the total number of users who have been referred to us via ads. Personal data such as the websites visited by the users are stored. Each time users visit our website, their personal data, including their IP address, is also transmitted to Google in the USA and stored there. i) Integration of Google Maps
Materna Virtual Solution has integrated content from Google Maps on its website. Google Maps is a service for displaying addresses on city plans and maps offered by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (hereinafter “Google”).
By visiting the Materna Virtual Solution website, Google receives the information that the user has accessed the corresponding subpage of our website. In addition, the data mentioned under point 4 a) is transmitted. This takes place regardless of whether Google provides a user account through which the user is logged in or whether no user account exists. If the users are logged in to Google, this data is assigned directly to their accounts. If users do not wish to be associated with their Google profile, they must log out beforehand.
Google stores this data as user profiles and uses it for the purposes of advertising, market research and/or the needs-based design of its website. j) Use of YouTube
Materna Virtual Solution has integrated YouTube videos on its website, which are stored on https://youtube.com/, so that these YouTube videos can be played directly on our website. Each time a Materna Virtual Solution website on which a YouTube video has been integrated is accessed, YouTube and Google receive information about which specific subpage of our website is visited by the user. In addition, the following information and personal data of the user is transmitted to YouTube IP address, date and time of the request including time zone, website accessed, amount of data transferred, browser, operating system and its interface, language and version of the browser software.
YouTube and Google always receive information via the YouTube component that users have visited our website if they are logged in to YouTube or Google at the same time as accessing our website; this takes place regardless of whether the users click on a YouTube video or not. This information is assigned to the user’s Google or YouTube account. If users do not want this information to be transmitted to YouTube and Google, they can prevent it from being transmitted by logging out of their YouTube accounts before accessing our website.
YouTube stores the data collected about users as usage profiles and uses these for the purposes of advertising, market research and/or the needs-based design of its website. k) Use of LinkeIn Ads, Analytics and Marketing Solutions
We use “LinkedIn Ads, Analytics and Marketing Solutions” on our website, a service provided by LinkedIn Ireland (hereinafter referred to as: “LinkedIn”). LinkedIn Ads stores and processes information about your usage behavior on our website. l) Use of Hubspot
Materna Virtual Solution uses HubSpot, a service of HubSpot Inc., on its websites for analysis purposes.
So-called “web beacons” are used and “cookies” are also set, which are stored on your computer and enable us to analyze your use of the website. HubSpot evaluates the information collected (e.g. IP address, geographical location, type of browser, duration of the visit and pages accessed) on behalf of Materna Virtual Solution in order to generate reports on the visit and the pages visited.

5. processing of personal data when supporting Materna Virtual Solution products – purpose and legal basis, recipients
Materna Virtual Solution collects and processes personal data for the purpose of supporting its products. Customers or interested parties can submit support requests via telephone, e-mail or the Materna Virtual Solution website on the following topics:
- Questions about the configuration
- Questions about the general mode of operation
- Reporting technical problems
- Requests for change requests
- Other technical inquiries
The incoming support requests and personal data transmitted by customers or interested parties are stored in an internal ticket system of Materna Virtual Solution and used for the purpose of documenting and processing the support request and for contacting the respective customers or interested parties in order to be able to provide appropriate feedback.
When a ticket is created in the Materna Virtual Solution ticket system, it automatically sends an e-mail to the e-mail address from which the message was received. This confirmation contains, among other things, a link via which the customers or interested parties can view the ticket they have created.

Materna Virtual Solution collects and processes the personal data of interested parties for the purpose of submitting offers and for sales purposes when an interested party contacts Materna Virtual Solution and expresses an interest in Materna Virtual Solution’s products. The contact details provided by the interested party to Materna Virtual Solution are stored and processed in Materna Virtual Solution’s CRM system. Materna Virtual Solution transmits the personal data of interested parties, which have been collected by Materna Virtual Solution for the purpose of submitting an offer or for sales purposes, to internal departments and sales partners or companies of the Materna Group for further sales processing and contacting the interested parties.
This processing of personal data of the interested parties by Materna Virtual Solution is either based on the consent of the interested parties (legal basis: Art. 6 para. 1 letter a GDPR) or is necessary for the implementation of pre-contractual measures (legal basis: Art. 6 para. 1 letter b GDPR).
7. processing of personal data for applications and in the application process – purpose and legal basis, recipients
Materna Virtual Solution collects and processes the personal data of applicants for the purpose of carrying out the application process. Processing may also be carried out electronically, e.g. if applicants send corresponding application documents by e-mail or use the applicant portal of the HR software Personio offered on the website to create an online application. Materna Virtual Solution has commissioned Personio SE & Co KG, Seidlstraße 3, 80335 Munich to process the personal data of an online application as a processor and for this purpose transmits the data collected from the data subject in the context of an online application to Personio SE & Co KG. Information from job-related social networks such as LinkedIn and Xing may also be used to assess an application. If Materna Virtual Solution concludes an employment contract with applicants, the transmitted data will be stored for the purpose of implementing the employment relationship in compliance with the statutory provisions. If Materna Virtual Solution does not conclude an employment contract with the applicants, the application documents will be deleted two months after notification of the rejection decision, unless longer storage is necessary due to the legitimate interests of the controller. Such a legitimate interest exists, for example, in the case of proceedings under the General Equal Treatment Act (AGG).
This personal data is not passed on to third parties outside the Group. Your personal data will not be transferred to countries outside the European Union.
This processing of personal data of applicants by Materna Virtual Solution is necessary for the execution of the application procedure and is based on the legal basis of Art. 6 para. 1 letter b GDPR, § 26 BDSG.
With your consent, we may transfer your personal data to companies affiliated with us, insofar as this is permissible within the scope of the stated purpose and legal basis. Furthermore, we may forward your application documents to companies of the Materna Group within the scope of applicant management. The legal basis for this is your consent pursuant to Art. 6 para. 1 lit. a GDPR. You can revoke this at any time with effect for the future.
8. obligation of the data subject to provide personal data and possible consequences of non-provision
The data subject is obliged to provide us with personal data if we conclude a contract with them. Failure to provide the personal data would mean that the contract with the data subject could not be concluded. In addition, the provision of personal data is necessary for the use of the products and the website of Materna Virtual Solution. Failure to provide the personal data would mean that the products or the Materna Virtual Solution website could not be used or could only be used with a limited range of functions.

Materna Virtual Solution will no longer process the personal data unless Materna Virtual Solution can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms or for the establishment, exercise or defense of legal claims.
2. right to object to direct advertising
If Materna Virtual Solution processes personal data for direct marketing purposes, the data subject shall have the right to object at any time to processing of personal data concerning him or her for such marketing, which includes profiling to the extent that it is related to such direct marketing. If the data subject objects to the processing for direct marketing purposes, the personal data will no longer be processed for these purposes.
